Identification - Civil War Officer Photography taken from album dated 1862

last year I bought an album containing handwritten poems and some photographies. The first dated entry within the album is 22 Jan 1862.
Please help me identify this officer most likely out of the American Civil War.

I suspect that this might be a portrait of Giuseppe Garibaldi (1820-1884) - and not an image of a civil war solder.

See for example these  portraits of him wearing a similar shirt and carrying a similar sword.
